1. Acceptance of these terms

These Terms of Service ("Terms") are a binding agreement between you and Ninety XI ("Ninety XI", "we", "us", or "our") governing your access to and use of the website at www.ninetyxi.com and the related Ninety XI football platform (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country, such as 16 in parts of the EU) to use the Service. By using the Service, you confirm that you meet this requirement and that the information you provide is accurate.

3. Your account

You are responsible for the activity that happens under your account and for keeping your password confidential. Provide accurate information when you register, keep it current, and do not share your account or impersonate anyone. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

4. Acceptable use

When using the Service, you agree not to:

• Break the law or infringe anyone's rights.
• Post content that is unlawful, harassing, hateful, defamatory, obscene, or otherwise objectionable.
• Harass, abuse, threaten, or impersonate other users or any person.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems, or interfere with or disrupt the Service.
• Scrape, harvest, copy, or redistribute data from the Service (including football data) except as expressly permitted, or use bots or automated means without our permission.
• Manipulate predictions, virtual points, leaderboards, votes, or any other feature, or attempt to circumvent limits or security measures.

5. User content

The Service lets you submit content such as comments, reactions, votes, predictions, and profile details ("User Content"). You retain ownership of your User Content. By submitting it, you grant Ninety XI a worldwide, non-exclusive, royalty-free license to host, store, display, and use that content to operate and promote the Service.

You are solely responsible for your User Content and confirm you have the rights to submit it. We may review, moderate, remove, or restrict any content that we believe violates these Terms or could harm the Service or other users, though we are not obligated to monitor content.

6. Predictions and virtual points

Ninety XI includes a prediction game that uses virtual points only. Virtual points are a feature of the Service for entertainment and competition. They have no monetary value, cannot be purchased for cash value, and cannot be sold, transferred, redeemed, or cashed out. The Service does not offer real-money gambling or wagering of any kind.

We may grant, adjust, void, or reset virtual points and may correct settlements or leaderboards to fix errors, account for data corrections, or address misuse. Predictions lock at kickoff and cannot be changed afterward.

7. Sponsored content and third-party links

The Service displays sponsorships and advertising, which are visibly labeled. We are not responsible for the products, services, content, or privacy practices of advertisers or any third-party sites you reach through the Service. Your dealings with third parties are solely between you and them.

8. Football data and accuracy

Match data, scores, lineups, statistics, and related information are provided by third-party data providers and are made available on an "as is" basis. This information may be delayed, incomplete, or inaccurate. You should not rely on it for any betting or financial decision. Ninety XI is an informational and entertainment product and is not affiliated with any league, club, or governing body unless expressly stated.

9. Intellectual property

The Service, including its design, text, graphics, logos, and software, is owned by Ninety XI or its licensors and is protected by intellectual property laws. Except for your own User Content, you may not copy, modify, distribute, or create derivative works from the Service without our permission. Club crests, competition marks, and similar imagery are the property of their respective owners and are used under the rights provided by our data partners.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any information it provides is accurate or complete.

11. Limitation of liability

To the maximum extent permitted by law, Ninety XI and its affiliates, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or profits, arising out of or related to your use of (or inability to use) the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless Ninety XI from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms or of any law or third-party right.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination (such as content licenses you have granted, disclaimers, and limitations of liability) will survive.

14. Changes to the Service and these terms

We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time; when we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws applicable in Ninety XI's principal place of business, without regard to conflict-of-law rules, except where mandatory consumer-protection laws of your country of residence apply. Disputes will be handled by the courts with appropriate jurisdiction, subject to those mandatory protections.
